Couples seeking surrogacy in India must be a legally married couple, with the female between the age of 23-50, whereas the male should be between 26-55 years of age. Women who are widows or divorcees between the age of 35-45 are also eligible for surrogacy. Although women with a living child from her previous marriage are not eligible.
The documents that are required include the following:
- Proof of marriage.
- Certificate of medical indication obtained from the District Board.
- Certificates of age and essentiality.
- A certificate of eligibility from the Board.
- Insurance or certificates for the surrogate’s psychological health and medical fitness.
- A medical indication from the District Court.
The intended parents must bring a willing surrogate, who must be married with at least one child and she should be between the ages of 25-35. According to the Surrogacy (Regulation) Act, 2021, a woman can only act as an altruistic surrogate mother once in her lifetime.
